Article 1. Definitions

In these Terms of Use, the following capitalised terms have the meaning set out below, unless the context expressly requires otherwise.

Affiliate Link: a hyperlink placed on the Platform that directs to an external website (for example a book retailer), in respect of which the Operator may receive a commission on click through or purchase, at no extra cost to the User.

Contribution: any text or other expression placed on the Platform by a User, including reflections on the community wall.

Contributor: a natural person who submits a Contribution on the Platform.

GDPR: Regulation (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data, together with any equivalent national implementing legislation.

Gift: a voluntary contribution of money without consideration, made through the Platform and governed by the Giving and Refund Policy.

Moderation: the assessment process to which a Contribution may be subjected before or after becoming publicly visible, performed in part automatically by means of artificial intelligence and in part manually.

Operator, "we", "us", "our": Faith.network, registered with the Netherlands Chamber of Commerce (KvK) under number 84972599, Jan van der Heijdenstraat 26 K, 3261 LE Oud-Beijerland, the Netherlands.

Platform or Faith.network: the platform operated by the Operator, accessible through faith.network and related (sub)domains and language editions.

User: any natural or legal person making any use of the Platform, including Visitors and Contributors.

Visitor: any person who accesses the Platform without submitting a Contribution.

Article 2. Scope and applicability

1. These Terms of Use apply to all use of the Platform and to all legal relationships between the Operator and any User arising from such use.

2. By accessing the Platform, starting a Bible study, submitting a Contribution, subscribing to the newsletter, enabling notifications or making a Gift, the User accepts these Terms of Use.

3. In addition to these Terms, the following documents apply and form part of them, whereby in case of conflict the more specific provisions prevail: the Privacy Policy and Cookie Policy in respect of the processing of personal data, the Disclaimer in respect of the nature of the content, and the Giving and Refund Policy in respect of Gifts.

4. If any provision of these Terms is or becomes wholly or partially invalid or unenforceable, the remaining provisions remain in full force. The invalid provision shall be replaced by a provision that approximates the intent of the original as closely as reasonably possible.

5. Any ambiguities regarding the content or interpretation of these Terms, or situations not addressed in them, shall be construed in accordance with their spirit and purpose.

6. The Operator's failure to enforce strict compliance with any provision at any time shall not constitute a waiver of its right to enforce that provision in the future.

7. The version of these Terms in force at the time of the relevant action governs that action.

Article 3. Nature of the Platform

1. Faith.network is a free online Bible study platform. It offers Bible explanations at several reading levels and lengths, daily moments of reflection, reading plans, videos, a children's section and a daily newsletter. Explanations and reflections are generated with the help of artificial intelligence, carefully instructed to stay with Scripture as its source; Bible text is quoted from public domain translations such as the World English Bible. Everything on the Platform is free to use and will remain free.

2. In respect of Contributions placed by Users on the community wall, the Operator acts as a provider of a hosting service within the meaning of Article 6 of the Digital Services Act (Regulation (EU) 2022/2065). The Operator does not itself write Contributions and is not responsible for their content, save in the circumstances set out in Article 9.

3. The Platform is funded by voluntary Gifts and by modest affiliate commissions from the library of recommended books, as further described in the Disclaimer. Affiliate remuneration has no influence on the content of studies or on what the library recommends.

4. The Platform is not a party to any sale. Purchases made by a User at an external retailer reached through an Affiliate Link are concluded between that User and that retailer. The Operator is not a party to such transactions and shall not be liable for them.

Article 4. Access and use

1. Browsing and studying on the Platform is free of charge and does not require an account.

2. Users undertake to use the Platform solely for purposes that comply with applicable law, these Terms and the legitimate interests of the Operator and other Users.

3. It is expressly prohibited to: (a) use the Platform in a manner that damages or endangers its operation, accessibility or security; (b) employ automated means such as scrapers, bots or comparable technologies to extract content or data from the Platform without prior written consent of the Operator; (c) impersonate another person or organisation; (d) provide false, misleading or fraudulent information; (e) infringe the rights of third parties, including intellectual property rights and personality rights. Fair personal use, sharing links and quoting short passages with attribution are welcome.

Article 5. Community contributions

1. Parts of the Platform let a Contributor share a short reflection or response, together with a first name. A Contributor must be at least 16 years old.

2. By submitting a Contribution, the Contributor represents and warrants that: (a) the Contribution is the Contributor's own work and reflects their own words; (b) the Contributor holds all rights necessary to post the Contribution; (c) the Contribution does not infringe any rights of third parties, including copyright and rights to privacy of others; (d) the Contribution contains no personal data of third parties without their express consent; (e) the Contribution has not been paid for or sponsored by any party.

3. The Contributor is solely responsible for the accuracy of the information provided.

Article 6. Moderation

1. Contributions may be subjected to Moderation before or after publication. The Operator uses automated safeguards, assisted by artificial intelligence, and manual review.

2. Moderation evaluates, among other things: the absence of hateful, offensive, discriminatory, violent, sexual or otherwise inappropriate content; the absence of spam, automated submission or advertising; and consistency with the devotional purpose of the Platform.

3. The Operator reserves the right to refuse Contributions, edit them for length, or subsequently remove them where reasonable grounds exist, and shall provide a reasoned explanation where the Digital Services Act so requires.

Article 7. Prohibited content

1. The following content is not permitted on the Platform, by way of example and without limitation: (a) content that violates applicable law, public order or accepted standards of decency; (b) content of a hateful, discriminatory, abusive, harassing, threatening or violent nature; (c) sexually explicit content; (d) content that violates the privacy, honour or reputation of a third party; (e) content that infringes intellectual property rights of third parties; (f) content of a commercial nature, including advertisements and promotional links; (g) false, fabricated or misleading content; (h) content containing harmful software or links to malware; (i) content that shares personal data of third parties without their express consent.

2. The Operator shall remove content that violates this Article as soon as it reasonably becomes aware of the violation.

Article 8. Licence to contributions

1. The Contributor retains copyright in their Contributions.

2. By submitting a Contribution, the Contributor grants the Operator a worldwide, royalty free, non exclusive licence to use, display, reproduce and adapt for display purposes the Contribution in the context of the Platform.

3. The Contributor may request removal of their Contribution at any time by writing to connect@faith.network. The Operator shall honour such requests promptly.

Article 9. Notice and Action

1. Any natural or legal person may notify the Operator of content on the Platform that the notifier considers unlawful. Notifications shall be sent to connect@faith.network marked "Notice and Action".

2. A notification must contain at least: (a) a precise identification of the content concerned, preferably by URL; (b) a substantiated explanation of why the content is alleged to be unlawful; (c) the name and contact details of the notifier, except where the notification concerns alleged criminal offences relating to the sexual abuse of minors; (d) a good faith declaration that the information in the notification is accurate and complete.

3. The Operator shall acknowledge receipt without undue delay and handle the notification in a diligent, non arbitrary and objective manner.

4. Where the Operator decides, on the basis of a notification or on its own initiative, to remove content or render it inaccessible, the affected User shall receive a reasoned explanation in accordance with Article 17 of the Digital Services Act, except where this is prohibited by law.

5. The affected User may, within six months after receipt of that explanation, challenge the decision by writing to connect@faith.network marked "Internal Complaint". The complaint shall be handled by a person other than the one who took the original decision.

6. Manifestly unfounded or repeatedly malicious notifications may be rejected, and in cases of systematic abuse the Operator may suspend the handling of further notifications from the notifier concerned, in accordance with Article 23 of the Digital Services Act.

Article 10. Nature of the content

The studies and reflections on the Platform are devotional material generated with care, but they are not a substitute for your own reading of Scripture, your church community, or professional advice of any kind. The Disclaimer applies in full and forms part of these Terms.

Article 11. Newsletter and notifications

The newsletter and push notifications are opt in. Every newsletter contains an unsubscribe link that works immediately, and notifications can be turned off in your browser or device at any time.

Article 12. Gifts

The Platform is funded by voluntary Gifts, processed by Stripe and governed by the Giving and Refund Policy. A Gift is a voluntary contribution without consideration: it does not buy a product, service or privilege, and everything on the Platform stays equally free for everyone.

Article 13. Intellectual property

1. All intellectual property rights in the Platform, including its design, structure, software, branding, name and the compilation of the whole, belong exclusively to the Operator or its licensors. Contributions remain the Contributor's (Article 8) and public domain Bible text remains public domain.

2. It is prohibited to systematically copy, reuse, scrape, data mine or otherwise commercially exploit parts of the Platform without the Operator's prior written consent, save to the extent expressly permitted by mandatory law.

3. Infringement of the rights protected under this Article is subject to an immediately payable penalty of ten thousand euros (10,000 euro), increased by five hundred euros (500 euro) for each day the infringement continues, without prejudice to the Operator's right to claim full damages and costs.

Article 14. Availability of the Platform

1. The Operator aims for the highest possible availability but provides no guarantee of uninterrupted or error free operation.

2. The Operator is entitled at any time to adapt, suspend or terminate the Platform or parts thereof. Where reasonably possible, such changes shall be announced in advance on the Platform.

Article 15. Liability

1. The Platform is provided free of charge and as is. The Operator shall only be liable for direct damages that are the direct result of an attributable breach, wilful misconduct or gross negligence of the Operator itself.

2. The Operator shall not be liable for: (a) the content of Contributions posted by Users, save to the extent that the Operator fails to remove unlawful content within a reasonable period following a valid notification under Article 9; (b) acts or omissions of external retailers reached through Affiliate Links; (c) acts or omissions of third parties engaged in connection with the operation of the Platform, including AI providers, payment service providers and hosting providers; (d) damages resulting from the temporary or permanent unavailability of the Platform; (e) damages resulting from loss of data, to the extent not reasonably attributable to the Operator; (f) damages resulting from reliance on content of the Platform, as further described in the Disclaimer.

3. Liability for indirect damages, including consequential loss, loss of profit, reputational damage and intangible damages, is excluded to the extent permitted by law.

4. To the extent the Operator may nonetheless be liable, its liability per event or series of related events shall be limited to five hundred euros (500 euro). If an insurer of the Operator makes a payment in the relevant case, liability shall in any event be limited to the amount paid out by that insurer.

5. The limitations in this Article do not apply to the extent the damages result from wilful misconduct or gross negligence of the Operator, and nothing in these Terms limits or excludes any liability that cannot legally be limited or excluded under the mandatory consumer protection laws of the User's country of residence.

6. Any claim against the Operator lapses upon expiry of one year after the event giving rise to the claim, or one year after the date on which the User became aware or could reasonably have become aware of the facts on which the claim is based.

Article 16. Indemnification by the User

1. The User shall indemnify the Operator against claims by third parties arising from: (a) Contributions posted by the User; (b) improper or misleading use of the Platform by the User; (c) any act or omission of the User in violation of these Terms, applicable law or the legitimate interests of third parties.

2. The User shall compensate the Operator for damage suffered as a result of such acts or omissions, including reasonable legal costs.

Article 17. Force majeure

1. The Operator shall not be obliged to perform any obligation where it is prevented from doing so by a circumstance that is not attributable to its fault and that does not lie within its risk by law, legal transaction or generally accepted practice.

2. Force majeure includes: disruptions of internet, telecommunications or electricity supply, cyberattacks, failures of third party services including hosting, AI and payment providers, pandemics, acts of war, and changes in laws and regulations.

Article 18. Complaints

1. Complaints concerning the functioning of the Platform may be submitted in writing to connect@faith.network marked "Complaint".

2. The Operator shall acknowledge receipt within five business days and respond substantively within fourteen days, unless the nature of the complaint requires a longer investigation period, in which case the User shall be informed.

3. Complaints concerning decisions on content follow the procedure of Article 9.

Article 19. Amendments

1. The Operator may amend these Terms from time to time. Amendments are made public by publication on the Platform.

2. Substantial amendments materially affecting the position of Users shall additionally be announced on the Platform at least thirty days prior to entry into force. A User who objects to a substantial amendment may cease using the Platform.

Article 20. Governing law and competent court

1. These Terms and all legal relationships between the Operator and Users are governed exclusively by Dutch law, with mandatory consumer protection law of the country of residence of any consumer User remaining unaffected. The applicability of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded.

2. Disputes that cannot be resolved by mutual agreement shall be submitted to the competent court in Rotterdam, the Netherlands, unless mandatory law designates another competent court. For Users qualifying as consumers, this applies only to the extent permitted by law; consumers may bring proceedings before the courts of their country of residence where the law so provides.

3. Consumers residing in the European Union may additionally rely on the Online Dispute Resolution platform of the European Commission, accessible at ec.europa.eu/consumers/odr.

Article 21. Final provisions

1. These Terms have been drawn up in English. Where the Platform makes available versions in other languages, translations are provided for convenience; in case of substantive divergence, the English version prevails for the international (English language) Platform, save where the mandatory law of the User's country prescribes otherwise. For language editions of the Platform, the version in that language prevails for that edition once published.

2. In situations not provided for in these Terms, the Operator shall decide in accordance with reasonableness and fairness, with due regard for the spirit of these Terms.
